Frequently Asked Questions

What is stamp duty?

Stamp duty is a tax levied by state governments on property transactions. It is a percentage of the property value or the circle rate (whichever is higher) and must be paid to legally register the property.

Is stamp duty different for men and women?

Some states offer concessions for women buyers. Delhi offers 4% stamp duty for women vs 6% for men. Similar rebates exist in Rajasthan, Haryana, and UP.

Can I claim stamp duty deduction in income tax?

Yes! Stamp duty and registration charges are eligible for deduction under Section 80C up to ₹1.5 lakh in the year of payment. This is only available in the old tax regime.

What is circle rate?

Circle rate (or guideline value) is the minimum property value fixed by the government for stamp duty calculation. If you buy below circle rate, stamp duty is still calculated on the circle rate.

When is stamp duty paid?

Stamp duty must be paid before or at the time of property registration. Delayed payment attracts a penalty of 2% per month (varies by state) on the unpaid stamp duty amount.
